Od klient\u016f v\u00edm, \u017ee pr\u00e1vn\u00ed slu\u017eby nemovitosti pat\u0159\u00ed mezi ty nejm\u00e9n\u011b obl\u00edben\u00e9 starosti.<\/p>\n\n\n\n<p>Dob\u0159e proveden\u00fd <a href=\"https:\/\/www.maklermartin.cz\/2021\/02\/12\/jak-provest-odhad-ceny-nemovitosti\/\" target=\"_blank\" rel=\"noreferrer noopener\">odhad tr\u017en\u00ed ceny nemovitosti<\/a> a&nbsp;strhuj\u00edc\u00ed <a href=\"https:\/\/www.maklermartin.cz\/2021\/02\/19\/inzerce-nemovitosti\/\">inz<\/a><a href=\"https:\/\/www.maklermartin.cz\/2021\/02\/19\/inzerce-nemovitosti\/\" target=\"_blank\" rel=\"noreferrer noopener\">erce nemovitost\u00ed<\/a>, kter\u00e1 si ukradne pozornost z\u00e1jemc\u016f, nejsou jedin\u00fdmi p\u0159edpoklady v\u00fdhodn\u00e9ho prodeje.<\/p>\n\n\n\n<p>Ty nejd\u016fle\u017eit\u011bj\u0161\u00ed pr\u00e1vn\u00ed slu\u017eby nemovitosti, na kter\u00e9 je lep\u0161\u00ed nezapomenout, jsem proto shrnul v&nbsp;tomto \u010dl\u00e1nku.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Z\u00e1kladn\u00ed pr\u00e1vn\u00ed \u00fakony<\/strong><\/h4>\n\n\n\n<p>Podrobn\u00fd v\u00fdpis v\u0161ech nutn\u00fdch krok\u016f, kter\u00fdmi mus\u00edte p\u0159i prodeji nemovitosti proj\u00edt, by sta\u010dil na celou knihu. Ve stru\u010dnosti v\u00e1m p\u0159edstav\u00edm ty nej\u010dast\u011bj\u0161\u00ed.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Dolo\u017een\u00ed v\u0161ech d\u016fle\u017eit\u00fdch podklad\u016f<\/strong><\/li><\/ul>\n\n\n\n<p>Na \u00fapln\u00e9m za\u010d\u00e1tku prodeje nemovitosti je nezbytn\u00e9 nav\u0161t\u00edvit <a href=\"https:\/\/www.cuzk.cz\/\" target=\"_blank\" rel=\"noreferrer noopener\">katastr\u00e1ln\u00ed \u00fa\u0159ad<\/a> a&nbsp;<strong>podle v\u00fdpisu ov\u011b\u0159it<\/strong>, \u017ee nemovitost netrp\u00ed exekuc\u00ed, z\u00e1stavn\u00edm pr\u00e1vem nebo v\u011bcn\u00fdm b\u0159emenem.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Smlouva o&nbsp;smlouv\u011b budouc\u00ed kupn\u00ed<\/strong><\/li><\/ul>\n\n\n\n<p>P\u0159esn\u011b tak. Existuje smlouva stvrzuj\u00edc\u00ed, \u017ee v&nbsp;budoucnu prob\u011bhne podeps\u00e1n\u00ed smlouvy jin\u00e9. D\u00edky t\u00e9to smlouv\u011b <strong>budete m\u00edt jistotu<\/strong>, \u017ee kupuj\u00edc\u00ed pod rizikem sankce podep\u00ed\u0161e n\u00e1slednou kupn\u00ed smlouvu.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>\u00daschova kupn\u00ed ceny<\/strong><\/li><\/ul>\n\n\n\n<p><strong>Bezpe\u010dn\u00e1 forma \u00fahrady<\/strong> pro ob\u011b strany obchodu. Ve chv\u00edli, kdy je kupuj\u00edc\u00ed ozna\u010den za vlastn\u00edka, m\u016f\u017eete p\u0159ej\u00edt k&nbsp;<strong>p\u0159ed\u00e1n\u00ed nemovitosti<\/strong>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Da\u0148ov\u00e9 povinnosti<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/www.zakonyprolidi.cz\/cs\/1992-586\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Da\u0148 z&nbsp;p\u0159\u00edjmu<\/strong><\/a><strong> fyzick\u00fdch osob<\/strong><\/li><\/ul>\n\n\n\n<p>\u201cNa sv\u011bt\u011b nejt\u011b\u017e\u0161\u00ed v\u011bc k&nbsp;pochopen\u00ed je da\u0148 z&nbsp;p\u0159\u00edjmu.\u201c<\/p>\n\n\n\n<p>To pronesl s\u00e1m Albert Einstein. V&nbsp;p\u0159\u00edpad\u011b prodeje nemovitosti je skute\u010dnost takov\u00e1, \u017ee drtiv\u00e1 v\u011bt\u0161ina prod\u00e1vaj\u00edc\u00edch spln\u00ed z\u00e1konem stanoven\u00e9 podm\u00ednky pro <strong>osvobozen\u00ed<\/strong> od <a href=\"https:\/\/www.maklermartin.cz\/2021\/02\/05\/dan-z-prodeje-nemovitosti\/\" target=\"_blank\" rel=\"noreferrer noopener\">dan\u011b z&nbsp;p\u0159\u00edjmu z&nbsp;prodeje nemovitosti<\/a>.<\/p>\n\n\n\n<p>O va\u0161\u00ed povinnosti platit \u010di neplatit <strong>rozhodne doba<\/strong>, po kterou jste nemovitost vlastnili, bydli\u0161t\u011b a&nbsp;to, jak\u00fdm zp\u016fsobem s&nbsp;utr\u017een\u00fdmi pen\u011bzi za prodej nalo\u017e\u00edte.&nbsp;<\/p>\n\n\n\n<p>Od roku 2021 se \u201c\u010dasov\u00fd trest\u201c z&nbsp;p\u016fvodn\u00edch <strong>5 let prodlu\u017euje na 10 let<\/strong>.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Oznamovac\u00ed povinnost<\/strong><\/li><\/ul>\n\n\n\n<p>Rok 2021 s&nbsp;sebou nep\u0159inesl pouze zm\u011bnu rozhodn\u00e9 doby pro da\u0148 z&nbsp;p\u0159\u00edjmu p\u0159i prodeji nemovitosti. Dal\u0161\u00ed zm\u011bnou je <strong>povinnost nahl\u00e1sit<\/strong> p\u0159\u00edslu\u0161n\u00e9mu finan\u010dn\u00edmu \u00fa\u0159adu, \u017ee je v\u00e1\u0161 p\u0159\u00edjem z&nbsp;prodeje osvobozen\u00fd od dan\u011b a&nbsp;z\u00e1rove\u0148 dolo\u017eit, \u017ee jste splnili podm\u00ednku pro osvobozen\u00ed.<\/p>\n\n\n\n<p>Za neohl\u00e1\u0161en\u00fd p\u0159\u00edjem hroz\u00ed pokuta a\u017e 15&nbsp;% z&nbsp;p\u0159\u00edjmu z&nbsp;prodeje nemovitosti.<\/p>\n\n\n\n<p>T\u00edm seznam zdaleka nekon\u010d\u00ed. <strong>P\u0159i prodeji nemovitosti se nevyhnete<\/strong> ov\u011b\u0159ov\u00e1n\u00ed podpis\u016f, znaleck\u00fdm posudk\u016fm, n\u00e1vrhu na vklad a&nbsp;kolk\u016f atd. Chcete se <strong>vyhnout<\/strong> zbyte\u010dn\u00fdm p\u0159e\u0161lap\u016fm a&nbsp;pr\u00e1vn\u00edm chyb\u00e1m, kter\u00e9 mohou zp\u016fsobit \u0159adu nep\u0159\u00edjemnost\u00ed?<\/p>\n\n\n\n<p>P\u0159i zprost\u0159edkov\u00e1n\u00ed prodej\u016f nejsem na <a href=\"https:\/\/www.maklermartin.cz\/practice\/pravni-servis\/\" target=\"_blank\" rel=\"noreferrer noopener\">pr\u00e1vn\u00ed servis<\/a> s\u00e1m.
