Jak\u00fd je rozd\u00edl?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Tolik zklam\u00e1n\u00ed, kdy\u017e z\u00e1jemci doraz\u00ed na <strong>aukci nemovitosti<\/strong>, kde se nebouch\u00e1 klad\u00edvkem tak, jak je zvykem b\u011bhem dra\u017eby.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.maklermartin.cz\/2021\/07\/01\/co-je-prodej-aukci-a-jak-probiha\/\" target=\"_blank\" rel=\"noreferrer noopener\">Aukce nemovitosti<\/a> a&nbsp;dra\u017eba nen\u00ed to sam\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dnes si vysv\u011btl\u00edme <strong>p\u011bt podstatn\u00fdch rozd\u00edl\u016f<\/strong> mezi t\u011bmito term\u00edny.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Pr\u00e1vo si je vykl\u00e1d\u00e1 po sv\u00e9m<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Prvn\u00edm rozd\u00edlem <\/strong>mezi aukc\u00ed a&nbsp;dra\u017ebou tkv\u00ed v\u00a0legislativ\u011b. Legislativa je z\u00e1kon a&nbsp;p\u0159es ten nejede vlak. <strong>Dra\u017ebu<\/strong> p\u0159\u00edsn\u011b definuje z\u00e1kon o&nbsp;ve\u0159ejn\u00fdch dra\u017eb\u00e1ch \u010d. 26\/2000 Sb. Na druh\u00e9 stran\u011b pravidla <strong>aukce<\/strong> m\u016f\u017ee \u201elibovoln\u011b\u201c, v\u00a0r\u00e1mci ur\u010dit\u00fdch mantinel\u016f, pozm\u011b\u0148ovat s\u00e1m organiz\u00e1tor aukce. I&nbsp;tak je ale \u010d\u00e1ste\u010dn\u011b omezena ob\u010dansk\u00fdm z\u00e1kon\u00edkem \u010d. 89\/2012 Sb.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Klad\u00edvko vs pap\u00edrov\u00e1n\u00ed<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1jemci o&nbsp;nemovitost jsou \u010dasto zklaman\u00ed, kdy\u017e doraz\u00ed na aukci nemovitosti a&nbsp;k\u00a0jejich sm\u016fle se nedo\u010dkaj\u00ed \u017e\u00e1dn\u00e9ho bur\u00e1cen\u00ed dav\u016f, p\u0159ek\u0159ikov\u00e1n\u00ed a&nbsp;<strong>zu\u0159iv\u00e9ho bouch\u00e1n\u00ed klad\u00edvkem<\/strong>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Dal\u0161\u00ed rozd\u00edl <\/strong>mezi aukc\u00ed a&nbsp;dra\u017ebou. U&nbsp;<strong>dra\u017eby<\/strong> se skute\u010dn\u011b prod\u00e1n\u00ed dra\u017een\u00e9 v\u011bci, a&nbsp;tedy jmenov\u00e1n\u00ed nov\u00e9ho majitele, ur\u010duje klepnut\u00edm klad\u00edvka licit\u00e1tora. <strong>Aukci<\/strong> <strong>nemovitosti<\/strong> naopak doprov\u00e1z\u00ed stejn\u00e9 pap\u00edrov\u00e1n\u00ed jako b\u011b\u017en\u00fd prodej nemovitosti (kupn\u00ed smlouva).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>M\u016f\u017eete, nebo mus\u00edte<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Pokud se ur\u010d\u00ed v\u00edt\u011bz <strong>dra\u017eby<\/strong>, mus\u00edte tomuto \u0161\u0165astlivci nemovitost prodat. Opravdu <strong>MUS\u00cdTE<\/strong>. Naopak <strong>aukce<\/strong> v\u00e1s k\u00a0ni\u010demu <strong>nezavazuje<\/strong>. Klidn\u011b si to po ukon\u010den\u00ed aukce m\u016f\u017eete rozmyslet a&nbsp;nic neprod\u00e1vat. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nebo se m\u016f\u017eete rozhodnout prodat va\u0161i nemovitost z\u00e1jemci, kter\u00fd sice nenab\u00eddl nejvy\u0161\u0161\u00ed \u010d\u00e1stku, ale va\u0161e sympatie si z\u00edskal n\u011b\u010d\u00edm \u00fapln\u011b jin\u00fdm. Nap\u0159\u00edklad mo\u017enost\u00ed <strong>nemovitost uhradit ihned<\/strong> a&nbsp;hotov\u011b, nebo nem\u00e1 v\u00fdhrady k\u00a0podm\u00ednk\u00e1m ve smlouv\u011b.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Zdarma, nebo za poplatek<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Na <strong>dra\u017ebu<\/strong> v\u00e1s pust\u00ed pouze v\u00a0p\u0159\u00edpad\u011b, \u017ee p\u0159edt\u00edm zaplat\u00edte <strong>dra\u017eebn\u00ed jistotu <\/strong>= poplatek za \u00fa\u010dast. Ta je v\u00e1m n\u00e1sledn\u011b vr\u00e1cena, pouze pokud v\u00a0dra\u017eb\u011b neusp\u011bjete. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Aukce b\u00fdv\u00e1 zcela zdarma.<\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>A vyvol\u00e1vac\u00ed cena je\u2026<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">\u2026u dra\u017eby <strong>2\/3 odhadn\u00ed ceny<\/strong>. Aukce zase za\u010d\u00edn\u00e1 na <strong>libovoln\u00e9 sum\u011b<\/strong>, kterou si prodejce s\u00e1m ur\u010d\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Aukce nemovitosti a&nbsp;dra\u017eba<\/strong> nen\u00ed to sam\u00e9. Ale je mo\u017en\u00e9 vyu\u017e\u00edt obou strategi\u00ed p\u0159i prodeji nemovitosti. <a href=\"https:\/\/www.maklermartin.cz\/2021\/07\/08\/jak-poznat-zda-je-nemovitost-vhodna-pro-aukcni-prodej\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kdy se jak\u00e1 hod\u00ed<\/a>, to hodn\u011b z\u00e1le\u017e\u00ed na okolnostech. <a href=\"https:\/\/www.maklermartin.cz\/kontakt\/\" target=\"_blank\" rel=\"noreferrer noopener\">Napi\u0161te mi<\/a>.
